Статья посвящена рассмотрению проблем правового регулирования общественных отношений, возникающих при обеспечении детской безопасности в условиях дорожного движения. Анализируется законодательство в области безопасности дорожного движения. Определены факторы риска, влияющие на дорожно-транспортную обстановку.Обосновывается мнение расширить область применения состава статьи 5.35 Кодекса РФ об административных правонарушениях и отнести случаи нарушения обязанностей по защите прав и интересов детей, выразившиеся в непринятии мер по обеспечению их безопасности, родителем или законным представителем, который управлял автомобилем, когда в нем находился ребенок, допустив совершение правонарушения, административная ответственность за которые предусмотрена определенными статьями главы 12 КоАП РФ, к отягчающим ответственность обстоятельствам.Сделан вывод о целесообразности ведения учета правонарушений, предусмотренных некоторыми статьями главы 12 КоАП РФ, рассмотренных комиссиями по делам несовершеннолетних и защите их прав, где родитель или законный представитель был привлечен к административной ответственности по ст. 5.35 КоАП РФ за нарушение обязанностей по защите прав и интересов детей, выразившееся в непринятии мер по обеспечению их безопасности в условиях дорожного движения.
The article is devoted to the consideration of problems of legal regulation of public relations arising in ensuring child safety in traffic conditions. Road safety legislation is being analysed. Risk factors affecting the road transport environment have been identified.It is justified to expand the scope of application of article 5.35 of the Code of Administrative Offenses and to include cases of violation of obligations to protect the rights and interests of children, expressed in the absence of measures to ensure their safety by a parent or legal representative, Who was driving when the child was in it, having committed an offence, administrative liability for which is provided by certain articles of Chapter 12 of the Administrative Code of the Russian Federation, to aggravating circumstances.It was concluded that it was advisable to keep records of the offences provided for in some articles of chapter 12 of the Administrative Code of the Russian Federation, considered by the commissions for minors and the protection of their rights, where the parent or legal representative was brought to administrative responsibility under Art. 5.35 of the Administrative Code of the Russian Federation for violation of obligations to protect the rights and interests of children, expressed in the absence of measures to ensure their safety in traffic conditions.
